Terms of Service

These Terms of Service (“Terms”, “Agreement”) constitute a legally binding contract between you (“User”, “you”, or “your”) and LoserMeet (“we”, “us”, “our”, or the “Service”). By accessing, browsing, or otherwise utilising the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy, which is incorporated herein by reference.

If you do not accept these Terms unconditionally, you are not authorised to access or use the Service and must cease all such use immediately.

By utilising the Service, you represent and warrant that:

• •You have attained the age of eighteen (18) years or the age of majority in your jurisdiction of residence, whichever is greater
• •You possess the legal capacity to enter into binding contracts
• •You are not prohibited by law from accessing or using the Service

We reserve the absolute right to refuse service, terminate accounts, or remove content at our sole discretion, without notice or liability.

LoserMeet provides a platform for random video chat connections between users. The Service facilitates peer-to-peer audio and video communication via WebRTC technology. We act solely as an intermediary to enable such connections and do not participate in, monitor, or control the content of communications between users.

The Service is provided on an “as is” and “as available” basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice or liability.

4.1 Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to:

• •Immediately notify us of any unauthorised use of your account
• •Ensure that you log out from your account at the end of each session
• •Accept responsibility for all activities occurring under your account

We shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

5.1 Prohibited Conduct

You expressly agree not to engage in any of the following prohibited activities:

• •Transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• •Engaging in any form of harassment, intimidation, or bullying of other users
• •Impersonating any person or entity, or falsely stating or misrepresenting your affiliation
• •Transmitting any unsolicited or unauthorised advertising, promotional materials, or spam
• •Attempting to gain unauthorised access to the Service, other accounts, or computer systems
• •Using the Service for any illegal purpose or in violation of any applicable laws

5.2 Content Standards

All content transmitted through the Service must comply with applicable laws and these Terms. You are solely responsible for all content you transmit.

6.1 Our Intellectual Property

The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by LoserMeet or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes.

6.2 User Content

You retain all ownership rights in content you transmit through the Service. However, by transmitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, and process such content solely to the extent necessary to provide the Service.

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to such processing and warrant that all data provided by you is accurate.

We wish to emphasise that audio and video communications are transmitted peer-to-peer and are not recorded or stored by us. However, we cannot control what other users may record or capture during sessions.

8.1 No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOSERMEET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS STERLING (£100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless LoserMeet, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable legal fees, arising out of or relating to:

• •Your use of the Service
• •Your violation of these Terms
• •Your violation of any rights of another party
• •Your conduct in connection with the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

11.2 Jurisdiction

You agree that any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
